The article details testimony from a vehicle accident reconstruction expert in the ongoing wrongful death trial against Tesla in Miami federal court concerning a lawsuit around its Autopilot system.

According to Alan Moore, expert witness and mechanical & forensic engineer, the Tesla Model S involved in the fatal Key Largo crash had been deleted by the automaker after the incident. Moore stated, "In the forensic world, one thing we never want to do is change evidence. Here is evidence being changed."

Mr. Moore also added that despite Tesla's claim the deleted data was unrelated to the crash, he had never before encountered "autodeleted" data in over 700,000 lines of data review and that vision detection and forward radar object detection systems were added to the car while it was at a Tesla service center after the crash.

Mr. Schreiber, Ms. Birnbaum, and Mr. Hanumadass' expert witness also highlighted that driver George McGee had regularly misused the Autopilot system by resetting it after warnings rather than driving without it, stating, "Tesla recorded Mr. McGee's abuse and misuse of autopilot, but it didn't do anything with it. It didn't change his behavior, it didn't limit his use of the feature. Tesla's decision to allow autopilot use on this road was a bigger contributor to the accident than Mr. McGee's use of autopilot."

Mr. Moore also pointed out that Tesla opted not to geofence its Autopilot or use driver-monitoring cameras, unlike other manufacturers, despite such technology being available and capable of preventing accidents like this one. He emphasized, "The technology to restrict it is right there. Using autopilot outside of the [operational design domain] increases the risk of an accident. If Tesla had prevented autopilot use outside of the ODD, this crash would not have happened."
