Kevin S. Hannon, Partner at Singleton Schreiber in Denver, CO, was recently featured on Law 360. The article provides an overview of the recent response filed by Mr. Hannon and other attorneys on behalf of a class of New Hampshire residents against Saint-Gobain Performance Plastics Corp, holding that they are liable for the contamination of their properties with a toxic forever chemical.
"[The] Defendants' mere assertions that there is absence of proof of a claim, without backing up their assertions, simply fail," according to Mr. Hannon and the other attorneys, adding that, "Contrary to [the] defendants' contention, minor plaintiffs can recover damages for annoyance and discomfort (under trespass, nuisance, or negligence) caused by the injury to their peaceful enjoyment of the property that they live in together with their parents (i.e., persons who have a possessory interest in property with which defendants' trespass and nuisance interferes)."
The case is Brown et al. v. Saint-Gobain Performance Plastics Corp. et al., case number 1:16-cv-00242.
