In a court decision by a Texas Federal Judge, ICE must release a Dreamer who has been detained for 2 months. District Judge Kathleen Cardone declined to add any comment on the legal implications of the Current administration's practice of keeping immigrants detained under section 1225(b) of the Immigration and Nationality Act. Judge Coronde said, "A core benefit of DACA is that it allows recipients to live, study, and work in the United States without fear of arrest or deportation."

This action joins the larger nationwide order of other district courts. The order finds that the actions of ICE overlook the due process requirements of the law. Immigration officials arrested and detained Santiago on Aug. 3 at El Paso International Airport without a proper warrant while Santiago was on her way to work.

Several legal professionals have come to represent Santiago in this case, including Amy Rubenstein and Luis Cortes Romero of Novo Legal Group LLC, Christopher Benoit of Benoit Legal PLLC, Bridget Pranzatelli and Stephanie Ellen Norton of the National Immigration Project, and Marisa A. Ong of Singleton Schreiber LLP.
