El Paso Man Sues After Border Patrol Agent Allegedly Released, Shot Dog
Senior Counsel Marisa Ong of Singleton Schreiber LLP was featured in El Paso Times coverage of a newly filed federal lawsuit against the U.S. government on behalf of El Paso resident Seth Daw, whose dog Chop was fatally shot by a Border Patrol agent during a home search on September 9.
According to the report, agents searched Daw's home after receiving a tip about undocumented immigrants; none were found. The lawsuit alleges Daw secured his dog in a bathroom and told agents to notify him before entering that room, but that an agent later re-entered alone, opened the bathroom door, and shot the dog as it exited. The suit, which seeks $550,000 in compensatory damages, alleges assault, trespass and destruction of property, and negligence, and follows the Border Patrol's denial of an earlier damages claim.
"Seth did everything he was supposed to do, and an agent still went into a room he had no permission to enter and killed a healthy, harmless animal who had never hurt anyone," said Ong.
"Seth hasn't spent a single night in the home he was renovating and planning to buy since the day his dog was killed there," said Ong.
